1. Agreement to these terms
These Terms of Service ("Terms") govern your use of shaunbagwellmasonry.net (the "website"), operated by Shaun Bagwell Masonry ("we", "us", "our"). By using the website you agree to these Terms. If you don't agree, please don't use the website.
These Terms cover the website only. Any masonry or concrete work is governed by a separate written contract signed by you and us, and if that contract conflicts with these Terms, the contract controls.
2. About us and our license
Shaun Bagwell Masonry is a sole proprietorship based in Alpine, California, licensed by the California Contractors State License Board under license #979389, classification C-29 — Masonry. You can verify the license at cslb.ca.gov.
Contractors are required by law to be licensed and regulated by the Contractors State License Board, which has jurisdiction to investigate complaints against contractors if a complaint regarding a patent act or omission is filed within four years of the date of the alleged violation. A complaint regarding a latent act or omission pertaining to structural defects must be filed within 10 years of the date of the alleged violation. Any questions concerning a contractor may be referred to the Registrar, Contractors State License Board, P.O. Box 26000, Sacramento, California 95826.
3. Website content is general information
The website describes our services, typical San Diego cost ranges, building-code requirements and construction practices to help you understand a project. It is general information, not advice for your specific property:
- Prices are planning ranges, not quotes. Actual cost depends on site conditions, access, soil, engineering, permits, materials and scope, and is set only in a written proposal after an on-site visit.
- Code and permit information is a summary. Requirements change and depend on your property and jurisdiction. It is not engineering or legal advice. Where a project needs engineering or a permit, the engineer of record and the permitting authority decide what applies.
- Timelines are typical, not promised. Your proposal gives the timeline for your project.
We work to keep the website accurate and up to date, but we don't guarantee that every statement is complete or current.
4. Estimates, proposals and contracts
- Requesting an estimate through the website, by phone or by email does not create a contract, and doesn't commit you or us to any work.
- Free on-site estimates are provided at no cost and with no obligation.
- A binding agreement exists only when a written contract is signed by both you and us. Home improvement contracts include the terms and notices California law requires, including any right to cancel that applies.
- Our workmanship guarantee, and any other warranty, is provided under the terms written in your contract or proposal.
- Scheduling depends on availability, weather, material supply, engineering and permit approval.
- We may decline any request, including work outside our license classification or service area.
5. Information you send us
When you submit the form, call or email, you agree that:
- the information you provide is accurate, and you have the right to share it (for example, you own the property or are authorized by the owner);
- we may contact you by phone, and by email if you provided one, about your request; and
- we will handle your information as described in our Privacy Policy.
Please don't send sensitive personal or financial information through the website.
6. Acceptable use
You agree not to:
- submit false, misleading, automated or spam requests;
- try to gain unauthorized access to the website, its administration area or its systems;
- interfere with the website's operation, security or other users; or
- copy or scrape website content, photographs or data for commercial use without our written permission.
7. Intellectual property
The website's text, photographs of our work, logo, design and other content belong to Shaun Bagwell Masonry or are used with permission, and are protected by copyright and trademark law. You may view and share pages for personal, non-commercial purposes, such as sending a link to someone considering a project. Any other use requires our written permission.
8. Reviews and testimonials
Reviews shown on the website were written by customers on third-party platforms such as Google, and are reproduced as written. They describe individual experiences with specific projects. Every property and project is different, and a review isn't a guarantee of the same result.
9. Links to other websites
The website links to third-party websites, such as the Contractors State License Board, Google Maps and review platforms. We don't control those sites and aren't responsible for their content, availability or practices.
10. Disclaimers
The website is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties about the website, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee that the website will always be available, error-free or free of harmful components.
This section concerns the website only. It does not limit any warranty or guarantee given in a signed contract for work, or any right you have under law that cannot be waived.
11. Limitation of liability
To the fullest extent permitted by law, Shaun Bagwell Masonry will not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of, or inability to use, the website or its content, including decisions made in reliance on general information published on it.
This does not limit liability that cannot be limited under California law, and it does not affect your rights or our obligations under a signed contract for work.
12. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute about the website that isn't resolved informally will be brought in the state or federal courts located in San Diego County, California, unless the law requires otherwise. Disputes about project work are resolved as set out in your contract.
13. Changes to these Terms
We may update these Terms from time to time. The date at the top of the page shows when they last changed. Continuing to use the website after a change means you accept the updated Terms.
